COPYRIGHT and DMCA POLICY

 

NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

Please note: if you materially misrepresent that a product or activity is infringing your copyrights, you will be liable for damages (including costs and attorneys' fees). In this case, a company that sent an infringement notification seeking removal of online materials that were protected by the fair use doctrine was ordered to pay such costs and attorneys fees. The company agreed to pay over $100,000. Therefore, if you are not sure whether material available online infringes your copyright, we strongly suggest that you first contact an attorney.

All content, video, audio, images are most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution material is used for promotional purposes only and therefore qualifies as fair use under United States copyright law. Any other uses of this material, on VTV, Virtual Media or elsewhere, may be copyright infringement.

If you believe that your work has been infringed, or your intellectual property rights have been otherwise violated, please provide Virtual Media's Copyright Agent the following information:

1. Identify with sufficient detail the location and title or description of the copyrighted work that you believe has been infringed upon. For example, "The copyrighted work at issue is the text that appears on http://www.website.com/this_page.html" or, better and more specifically, a link to the media item URL such as, "http://www.website.com/media.swf" and is called "the title of work." 2. Your address, telephone number, and email address so that we might verify the claim. 3. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. 4. Provide information, if possible, sufficient to permit Virtual Media to notify the owner/administrator of the web page that allegedly contains infringing material (such as an email address). 5. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. This statement might look like: "I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law." 6. Include the following statement: "I swear, under penalty of perjury consistent with United States Code Title 17, Section 512, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed." 7. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
